America’s Top Zombie

  1. NO PURCHASE NECESSARY. Void where prohibited. America’s Top Zombie (the “Contest”) is open to anyone
who is at least 13 years old by February 1, 2008. Employees of the Sponsors (as defined below) and their immediate
families, their IRS dependants, and members of their same households are ineligible. Anyone who attempts to
defraud or in any way tamper with the Contest will be ineligible.
  2. HOW TO ENTER: Contest begins at 11:59 a.m. (p.s.t.) on March 10, 2008 and ends on 12:00 p.m. (p.s.t.) June
31, 2008 (the “Deadline”). To enter (1) with a camera, shoot a video of yourself as a zombie (a maximum of two (2)
minutes in length), (2) upload the video entry to veoh.com or to horrorchannel.com and (3) download the entry form
at: http://www.mindsplintersfilms.com/youcanbeinournextmovie.html, fill out the entry form and email it to:
contest@mindsplintersfilms.com or mailed to: Atten: Dennis Baker 150 Fourth Ave. North, Ste. 700
Nashville, TN 37219-24171. All video entries must be uploaded by the Deadline and all mail-in entry forms must be
mailed separately, postmarked by June 31, 2008 and received by July 5, 2008. Any form of entry other than those
described herein is void. Only one entry per person is permitted. To be eligible to win a prize, both a video entry and
the form entry must have been received by the deadline. If you are under the age of eighteen (18) (a "Minor"), one
of your parents or legal guardians must submit a signed, written statement that they have read, understood and
agree to these Contest rules with your entry form, and that such agreement constitutes acceptance of these Contest
rules on behalf of you and themselves .
  3. SELECTION AND NOTIFICATION OF WINNERS: All entries will be reviewed and judged by the following four (4)
member panel of judges: Nicholas Psaltos, CEO, the Horror Channel; Sarah Pierce, from NBC Universal’s Chiller
Channel; Aaron Lam, from Ghost House Pictures; FearsMag (I still do not understand this is it part of Ghost House
Pictures or calico cooper or is it a fifth sponsor? If fifth sponsor need to revise number above)); and Calico Cooper.
One winning entry and nine runner-up entries shall be chosen based upon the following criteria: 40% on acting
skills, 40% for makeup, and 20% for set design. (Odds of winning depend on the number of eligible entries
received.) Entries become the sole property of Sponsors and will not be returned. Winner(s) will be notified by
phone, mail and/or email on or about Aug 1, 2008. If a potential winner cannot be reached after 5 days from first
notification attempt, or a potential winner is found to be ineligible or does not comply with the Official Rules, the prize
will be forfeited and an alternate winner may be selected by a second random drawing. Entrants agree to be bound
by the Official Rules and any and all decisions of the judges, which are final and binding in all respects.
  4. PRIZE(S): Grand Prize (1) Sponsors will integrate a clip (a maximum length of 30 seconds) from the winning
entry into a three minute special production video (the “Video”) based on the content from the winning entry. The
Video may include interviews with the winner. The Video will be featured on mindsplintersfilms.com, the
Horrorchannel.com and Veoh Network’s horror/scifi channel for at least 24 hours and may subsequently be removed
as a feature from these sites at the discretion of each site’s respective editor; (2) the Video will appear in the Day of
the Dying Living (the “Series”), and the winner will be awarded an end credit in the episode of the Series in which the
Video appears; (3) a special engraved plaque for “America’s Top Zombie;” (4) a Starz horror DVD collection worth
approximately $250.00; (5) a signed copy of the newly released book titled “Haunted Colorado” by Director Dennis
Baker; and (6) a horror themed t-shirt. Total Approximate Retail Value of Grand Prize: $750.00. Runner-up Prizes
(1) a signed copy of the newly released book titled “Haunted Colorado” by Director Dennis Baker(2) a horror themed
t-shirt; and (3) Sponsors may integrate an excerpt from any of the runner-up entries into the Video. Total
Approximate Retail Value of Runner-up Prize: $100.00.
  5. PRIZE LIMITATIONS: All expenses not specifically included in the prize as described in these Official Rules are
hereby excluded. Winner(s) may not substitute another prize or receive a cash equivalent. Sponsors, at their sole
discretion, may substitute a prize or cash of equal or greater value for any reason. Any depiction of prizes is for
illustrative purposes only. Contest is subject to these Official Rules and all applicable federal, state and local laws.
Winner(s) are solely responsible for all taxes on prizes. Sponsors are not responsible for delay in prize delivery.
  6. WINNERS RELEASE FORMS: Winner(s) must execute, notarize and return within 5 days of receipt by Winner a
liability release, a publicity release (where legal), and any other documentation that Sponsors require. Except where
prohibited by law, each Winner’s acceptance of prize is permission for Sponsors to use each Winner’s name, photo,
likeness, biographical information, statements, voice, and address (city and state only) for advertising/publicity
purposes worldwide and in all media, without further compensation. If Winner is under 19 in AL or NE or under 21 in
CO, MS, PA or WV, or under 18 in any other state, his/her legal guardian must also sign the applicable releases and
documentation.
  7. LIMITATION OF LIABILITY: By entering the Contest, each entrant releases the Sponsors, their advertising and
promotion agencies, and any agents involved in the development, production or handling (including prize suppliers),
implementation and distribution of this Contest, and their respective parent companies, affiliates, subsidiaries,
service providers, officers, employees and any other person/entity associated with the Contest (collectively, the
“Contest Entities”) from any and all liability for losses/injuries/expenses of any kind (including, without limitation,
property damage, personal injury and/or death) resulting from participation in the Contest including acceptance
and/or use/misuse of prize, or any typographical or other error in the printing, offering or announcement of any
prize. By entering the Contest, entrant also grants Sponsors the right to use entry information for marketing
purposes to the extent permitted by law, and releases Sponsors from any claims or liability relating to such use.
Entrants agree that none of the Contest Entities has made or is responsible for any representation or guarantee,
express or implied, in fact or in law, relative to the prizes.
  8. If for any reason the Contest cannot run as planned, Sponsors reserve the right to cancel/modify/suspend the
Contest and conduct the contest from all salvageable entries received, if any. Contest Entities are not
responsible/liable for multiple entries entered by other than human means or other mechanical means, or for entries
that are late (including delayed data transmissions), illegible, mutilated, forged, tampered with, destroyed,
incomplete, lost, misdirected, mechanically duplicated, mass machine printed, or postage-due, or entries otherwise
not in compliance with Official Rules (and all such entries will be disqualified). Contest Entities are not responsible or
liable for any technical malfunctions of the telephone network, computer online system, computer dating mechanism,
computer equipment, software, or any combination thereof, or any damage to an entrant’s or third person’s
computer and/or its contents.
  9. JURISDICTION: Any claims or lawsuits related to the Contest brought against any Sponsor shall be brought in
the federal or state courts of the State of California in the County of Los Angeles. By participating in the Contest,
you agree to the jurisdiction and venue of such courts, and waive all objections to such jurisdiction and venue.
 10. OFFICIAL RULES AND WINNERS LIST: For Official Rules/Winners List send (by May 31, 2008) a self-
